Eligibility
The Rubio’s Coastal Grill® Rubio’s Tacos for a Year Sweepstakes (the “Sweepstakes”)  is open only to legal residents of, and residing in, California (CA), Arizona (AZ) and Nevada (NV) who are at least eighteen (18) years of age or older and a Rubio’s Rewards Member at the time of entry. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law. The following individuals are not eligible to enter or win a prize: directors, officers, employees, representatives, and agents of Sponsor, and of Sponsor’s parents, subsidiaries, or affiliated companies, marketing agencies, and any other parties involved in the administration of the Sweepstakes (Sponsor, collectively with the foregoing, “Sweepstakes Parties”) and each of the immediate family members of such excluded individuals (i.e., spouses, parents, children, siblings and the “steps” of each and each of their respective spouses) and all persons living in the same household of each, whether or not related.

By participating in these Sweepstakes, entrants agree to be bound by these official rules (“Official Rules”) and by the decisions of the Sponsor in all matters relating to the Sweepstakes. All applicable federal, state, and local laws apply. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Sweepstakes Period
The entry period for the Sweepstakes begins on October 4, 2024 at 12:00:00 a.m. Pacific Standard Time (“PST”) and ends on October 4, 2024 at 11:59:59 p.m. PST (the “Entry Period”). Sponsor’s computer is the official time-keeping device for the Sweepstakes.

How to Enter
There are two (2) ways to enter the Sweepstakes:

a) Ordering In-App, Online or In-Store: You must have an existing Rubio’s Rewards account or create a new Rubio’s Rewards account (mobile on iOS and Android, or web account registered through rubios.com/rewards) to be eligible to enter the Sweepstakes via this method. You will receive one (1) entry for a purchase made during the Entry Period by ordering through the Rubio’s App, online at order.rubios.com using your Rubio’s Rewards account, or in a Rubio’s restaurant with a Rubio’s Rewards account check-in prior to the completion of the transaction. Post-purchase check-ins must be completed prior to winner selection date on or about October 4, 2024. Orders placed on any third-party platforms (including third-party delivery marketplaces such as DoorDash, GrubHub, Uber Eats, Postmates, EZ Cater or Foodja) do not qualify towards any entry. You may not use more than one Rubio’s Rewards account for purposes of entering the Sweepstakes. Limit one (1) entry during the Entry Period. Additional Rubio’s Rewards check-ins during the Entry Period will not increase your chances of winning.

b) Alternative Post Mail Method of Entry: During the Sweepstakes Period, to participate without using your smart phone, computer, Rubio’s app, or visiting a participating Rubio’s restaurant location, by legibly printing your full name, complete postal address (including zip code), home telephone number, e-mail address as it appears on your Rubio’s Rewards account, and the words “Tacos for a Year Sweepstakes entry” on a plain 3” x 5” card or piece of paper and mailing it with proper postage affixed in a sealed #10 envelope to: Rubio’s ATTN: TACOS FOR A YEAR SWEEPSTAKES, 2200 Faraday Ave, Suite 250, Carlsbad, CA 92008.

Limit of one (1) mail-in entry per person, per stamped outer mailing envelope. Subject to maximum of one (1) entry for the entire Sweepstakes. You will receive only one (1) entry regardless of total number of each completed eligible mail-in entry received. Each mail-in entry must be postmarked by October 4, 2024 and received by Sponsor no later than October 8, 2024. Sweepstakes Parties assume no responsibility for lost, late, incomplete, stolen, misdirected, illegible or postage-due entries or mail. No mechanically reproduced entries permitted. Illegible/incomplete entries are void.

Entrants must be a member of the Rubio’s Rewards Program at the time of entry regardless of entry method used. Maximum of one (1) entry per person regardless of the method of entry or combination of entry method used.

Odds of Winning:
Odds of winning are dependent on the number of entries received during the Entry Period.

Winner Selection and Notification
On or about October 9, 2024, ten (10) potential Grand Prize winners will be randomly selected from all eligible entries received. Sponsor will notify potential winners by email at the email address associated with their Rubio’s Rewards account (if such associated email address exists) or provided with their mail-in entry (as applicable), and/or by a Rubio’s app notification and message (as applicable). Potential winners must respond to the initial winner notification email within seventy-two (72) hours of it being sent. Potential winners may also be required to execute and return a Declaration of Eligibility, Liability and Publicity Release and/or IRS W-9 Form and provide a copy of valid photo identification (i.e. driver’s license, passport) within seventy-two (72) hours of Sponsor’s first winner notification email. Depending on prize value, winners may receive a Form 1099 for the value of the Prize awarded in 2024 and for the value of the Prize awarded in 2025.

The right to receive a prize is subject to Sponsor’s verification of a potential winner’s eligibility, including verification of age and residency and to the fulfillment of all requirements of these Official Rules. An Entrant is not a winner of any prize regardless of notification unless and until Entrant’s eligibility is verified by the Sponsor.

If a potential winner (i) is determined to be ineligible or otherwise disqualified by Sponsor due to noncompliance with these Official Rules, (ii) fails to respond to Sponsor’s first winner notification email within seventy-two (72) hours of notification), or (iii) fails to timely execute and return any documents required by Sponsor within seventy-two (72) hours of Sponsor’s first winner notification email, the potential winner will be disqualified and forfeit all interest in the prize in its entirety. Only three (3) alternate winners will be selected for any prize; after which, such prize shall remain unawarded. The Sponsor reserves the right to modify the notification procedures in connection with the selection of an alternate winner, if any.

Prizes and Prize Conditions and Restrictions
Ten (10) Grand Prizes (“Prizes”) are available and to be awarded. Each Grand Prize (“Prize”) is comprised solely of the following elements:

One (1) Free Taco Reward in their Rubio’s Rewards account every day for 365 consecutive days redeemable only for one day. No additional purchase is required. Approximate Retail Value (“ARV”): $2,660.85. Total ARV of all prizes: $26,608.50.

The winner must have a Rubio’s Rewards account. The Free Taco Reward will be deposited daily into the same account used to enter the Sweepstakes. If a winner deletes or cancels their Rubio’s Rewards account, they will forfeit the remaining unused portion of the prize. Winners may not transfer the prize to another Rubio’s Rewards account, even if the other Rubio’s Rewards account belongs to the winner. Reward can only be redeemed on the Rubio’s app, online at order.rubios.com for pick-up or native delivery, or in-restaurant scan at the register prior to the completion of the transactions. Reward cannot be on any third-party platforms (including third-party delivery marketplaces such as DoorDash, GrubHub, Uber Eats or Postmates). Any unused daily Reward will be forfeited at 11:59:59 p.m. PST on that day and the new daily Reward will appear at 12:00:00 a.m. PST the following day. Daily Rewards cannot be redeemed for cash or transferred or assigned. Additional restrictions may apply. Only one (1) Reward permitted per transaction. Upcharges for extras and premium items may apply. No substitutions. Sponsor has no responsibility for a winner’s inability or failure to accept or use any part of the Rubio’s Free Taco Reward as described herein.

Winners are solely responsible for all federal, state, and local taxes as well as any costs and expenses associated with acceptance and use of the Prize not specified herein as being provided, including any items excluded from the daily Reward.

Prize cannot be transferred, assigned or redeemed for cash by winners. Sponsor reserves the right to substitute a Prize (or portion thereof) of comparable or greater value, at its sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied. All Prize details are at Sponsor’s sole discretion. Limit one (1) Prize per person/household.

Publicity Grant
Except where prohibited by law, by winner’s acceptance of the Prize, winner grants Sponsor and its designees a perpetual, worldwide, royalty-free right and license to use their name, city and state of residence, photograph, voice, and likeness for promotion of this Sweepstakes and for any other promotional, advertising, publicity or other lawful purpose in any and all media now or hereafter advised, without additional compensation or notification to, or permission from, winner.

Limitation of Liability and Release
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE (I) SPONSOR AND THE OTHER SWEEPSTAKES PARTIES SHALL NOT BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF OR CONNECTED WITH (A) THE SWEEPSTAKES OR (B) ANY PRIZE AWARDED, AND (II) YOUR REMEDIES FOR ANY CLAIMS RELATING THE SWEEPSTAKES ARE LIMITED TO YOUR ACTUAL OUT-OF-POCKET EXPENSES OF PARTICIPATION IN THE SWEEPSTAKES (IF ANY).

Entrants, by participating, agree that Sweepstakes Parties will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize (including any travel or activity related thereto) or participation in this Sweepstakes. Sweepstakes Parties are not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, undelivered or garbled entries, transaction, email, mail, or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), platform, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the tabulation of transaction data, the announcement of the prizes or in any Sweepstakes-related materials. Sweepstakes Parties are also not responsible for any incorrect or inaccurate information, whether caused by site/app users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes. Sweepstakes Parties are not responsible for injury or damage to entrants’ or to any other person’s computer or other device related to or resulting from participating in this Sweepstakes. In the event of any ambiguity or error(s) in these Official Rules, Sponsor reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s). In no event will more than ten (10) prizes be awarded.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor may prohibit an entrant from participating in the Sweepstakes or winning the prize if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or any Sweepstakes Party.

Sponsor’s Reservation of Rights
If the Sweepstakes is not capable of running as planned for any reason, including without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, government orders, natural disasters, the effects of COVID-19 or any pandemic or any other causes which corrupt or affect the administration, security, failure of Rubio’s restaurants to open on time or operate properly, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right to award the prizes from among all non-suspect, eligible entries received up to time of such action or as otherwise deemed fair and appropriate by Sponsor.

Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Governing Law and Jurisdiction
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules. By entering, you consent to the jurisdiction and venue of the state and local courts located in San Diego County, California and the federal courts located in the State of California for the resolution of all disputes relating to the Sweepstakes and agree that any and all disputes shall be resolved exclusively in those courts. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

Privacy Policy
Any personal information supplied by you when entering this Sweepstakes will be subject to the Sponsor’s privacy policy posted on https://www.rubios.com/privacy. In addition, unless prohibited by the applicable privacy policy or by law, by entering the Sweepstakes, you grant the Sweepstakes Entities permission to share your email address and any other personally identifiable information with the other Sweepstakes Entities, and any other organizations affiliated with the sponsorship, fulfillment, administration, prize support, advertisement or promotion of the Promotion, for the purpose of administration and prize fulfillment.

Winner List
The winners (first name, last initial, and state of residence) will be publicly announced via the Rubio’s website, email and official social media pages, on or about October 15, 2024. Their identities will remain posted on the Sweepstakes web page and social media post for a minimum of 30 days subsequent to the determination. For the winners list (first name, last initial, and state of residence), send a self-addressed, stamped business sized envelope to Rubio’s ATTN: TACOS FOR A YEAR SWEEPSTAKES – Winner’s List, 2200 Faraday Ave, Suite 250, Carlsbad, CA 92008. Requests must be received no later than sixty (60) days after the Entry Period.
