Rubio’s Back to School Fundraiser Contest Official Terms and Conditions
1. Promotion Period
The Rubio’s Back to School Fundraiser Contest (“Contest”) begins September 22, 2026, and ends November 2, 2026 (“Promotion Period”). All fundraiser events must occur at a participating Rubio’s Coastal Grill location in California, Arizona, or Nevada during the Promotion Period.
2. Participation
All approved Rubio’s fundraiser events held at participating locations during the Promotion Period will automatically be included in the Contest.
Organizations may conduct more than one fundraiser event during the Promotion Period. However, each fundraiser event will be evaluated separately. Sales from multiple fundraiser events held by the same organization will not be combined for purposes of determining the Contest winners.
Each fundraiser event remains subject to Rubio’s standard fundraiser program requirements and any instructions provided as part of the fundraiser approval process.
3. Standard Fundraiser Donation
For each approved fundraiser event, Rubio’s will donate to the participating organization an amount equal to thirty percent (30%) of the event’s Net Eligible Sales.
“Net Eligible Sales” means total food and beverage sales attributable to the organization’s fundraiser event through the use of its assigned fundraiser code at the designated Rubio’s Coastal Grill location, whether placed:
(a) in person at the participating restaurant;
(b) through the Rubio’s website; or
(c) through the Rubio’s mobile application.
Net Eligible Sales exclude:
(a) sales tax;
(b) gift card purchases;
(c) retail merchandise sales;
(d) alcoholic beverage sales;
(e) tips, delivery fees, service fees, and other fees;
(f) purchases made through third-party ordering or delivery platforms;
(g) refunds, voids, canceled transactions, and complimentary items; and
(h) amounts removed through discounts or promotional offers.
Only purchases properly associated with the fundraiser’s assigned code at the time the order is placed will count toward Net Eligible Sales. Rubio’s is not responsible for purchases that are not properly attributed to the fundraiser event.
4. Contest Prizes
At the conclusion of the Promotion Period, the fundraiser events with the highest Net Eligible Sales will receive the following additional donations:
· First Place: An additional $1,000 donation to the organization associated with the fundraiser event having the highest Net Eligible Sales.
· Second Place: An additional $500 donation to the organization associated with the fundraiser event having the second-highest Net Eligible Sales.
These Contest donations are in addition to the standard 30% fundraiser donation earned by each winning event.
Awards are based on the performance of a single fundraiser event. If an organization holds multiple events, each event will be ranked independently, and sales from those events will not be aggregated.
An organization may receive no more than one Contest donation. If the same organization would otherwise qualify for both first and second place through separate fundraiser events, the organization will receive only the first-place donation. The second-place donation will then be awarded to the next-highest-ranked eligible fundraiser event conducted by a different organization.
5. Determination of Winners
Rubio’s will determine the winners based on its internal transaction and fundraiser records. Rubio’s records regarding fundraiser codes, qualifying purchases, Net Eligible Sales, refunds, voids, and other adjustments will be final and controlling.
If two or more fundraiser events have equal Net Eligible Sales, the event with the greater number of eligible transactions will receive the higher ranking. If a tie remains, the
fundraiser event that occurred earliest during the Promotion Period will receive the higher ranking.
Potential winners are subject to verification by Rubio’s. An organization may be required to confirm its information or provide documentation reasonably requested by Rubio’s before receiving an additional donation.
6. Fundraiser Conduct
Organizations and their representatives must comply with all fundraiser instructions and applicable laws. Organizations may promote their fundraiser events to supporters but may not:
(a) distribute promotional materials inside or immediately outside a Rubio’s restaurant without prior approval;
(b) interfere with restaurant operations or solicit Rubio’s guests who are not affiliated with the organization;
(c) make, arrange, or encourage artificial, fraudulent, refunded, or otherwise ineligible purchases for the purpose of increasing an event’s ranking; or
(d) misrepresent the organization’s relationship with Rubio’s or the terms of the fundraiser or Contest.
Rubio’s may disqualify an event or organization if Rubio’s reasonably determines that these terms have been violated, sales have been improperly attributed, or fraudulent or abusive activity has occurred.
7. Donation Processing
Standard fundraiser donations are processed after the applicable fundraiser event concludes and are typically delivered to the organization within four to six (4–6) weeks following the event date in the form of a check made payable to the organization.
Additional donations awarded through the Contest will be processed after the Contest results have been calculated and the winning organizations have been verified.
Rubio’s is not responsible for delays caused by incomplete or inaccurate organization information. If a donation check is returned as undeliverable, Rubio’s will make reasonable efforts to contact the organization. Unclaimed donations will be handled in accordance with applicable state unclaimed-property laws.
Organizations are responsible for providing accurate contact, mailing, and payment information and for any reporting or tax obligations associated with donations received through the fundraiser program or Contest.
8. Modification or Cancellation
Rubio’s reserves the right to modify, suspend, extend, or cancel the Contest if fraud, technical failures, restaurant closures, events beyond Rubio’s reasonable control, or other circumstances impair the administration, security, fairness, or intended operation of the Contest.
If a fundraiser event is canceled, rescheduled outside the Promotion Period, or otherwise cannot be completed, sales associated with that event may be excluded from the Contest. A rescheduled event occurring within the Promotion Period may remain eligible, subject to Rubio’s approval.
9. Limitation of Liability
To the fullest extent permitted by law, Rubio’s and its affiliates, employees, officers, agents, and participating restaurant locations will not be responsible for lost or misapplied fundraiser codes; technical, ordering, payment, or communications errors; incomplete or inaccurate organization information; or purchases that are not properly attributed to a fundraiser event.
Nothing in these terms limits any rights or remedies that cannot lawfully be excluded.
10. Interpretation
Rubio’s reserves the right to interpret and apply these terms, determine whether sales qualify, verify Contest results, and resolve any disputes concerning the Contest. Rubio’s decisions will be final to the extent permitted by law.
If any provision of these terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect.
